REGULATION FOR INTERACTION OF THE ONLINE SHOP AND THE CLIENTS OF RITO ONLINE SHOP
The Regulation for the interaction of the Online Shop and the Customers of RITO Online Shop (hereinafter referred to as Regulation, Regulation for Interaction, Public Contract) is a document determining the procedure for the purchase and sale of Goods through the Online Shop in accordance with Article 633 of the Civil Code of Ukraine, which is a Public Contract for the sale of goods and services related to the registration of the purchase and its delivery, the text of which is available on the website of RITO Online Shop at https://rito.ua
TERMS AND DEFINITIONS
For the purposes of this Regulation, the Terms listed in this clause shall have the meaning given below:
Authorization - an entry to the Customer's personal cabinet, which consists of entering the login and password of the registered Clients in the corresponding fields of the web page and pressing the "Login" button.
Activation is a procedure carried out in accordance with the procedure and conditions established by this Regulation, assuming verification of the Customer's data, giving the User the right and the technical ability to make a purchase using the Online Shop.
Acceptance is a full and unreserved acceptance of the Terms of the Public Contract by the User (the Client, the Buyer). Since the acceptance of the Terms of the Public Contract, the Online Shop in the person of its Owner and the User of the Site (the Customer, the Buyer) are its Parties.
Blocking - technical and organizational actions conducted by authorized staff of the Online Shop aimed at limiting or suspending the ability of the User (the Customer, the Buyer) to access the Site services for the purpose of preventing and as a preventive measure against violations of this Regulation on the Terms established in it.
Contract for the sale of Goods (the Transaction) is a Transaction concluded with the help of the Online Shop by the Seller and the Buyer, in rder to carry out a commodity-money exchange between them. Terms of the transaction are established by this Regulation.
Order – the Buyer's request issued in the appropriate order. The request made by the Buyer for the purchase of the Goods selected in the Online Shop, executed in an electronic form on the Site by the Customer himself and / or communicated by phone through the Contact Center employee. Confirmation of the fact of registration of the Order is the allocation of unique identification number to it.
RITO Online Shop (the online shop) is a site that sells Goods through the Internet.
Private Information is a personal information of the Customer, the information allowing identifying the Client when used alone or in combination with other available information.
The Client is a registered User.
Code word is a unique word (a collection of words, letters, and numbers) that is used to identify and verify the User.
Party - the Seller or the Buyer according to the general Terms and Conditions.
User / Customer login (User / Customer name) is the User / Customer ID on the Site, used to indicate it in the system that is simultaneously used to access the User / Client personal page, as well as for other purposes specified in this Regulation.
Public Contract (Offer) - a public offer of an Online Shop in the person of its Owner, addressed to any individual, to accept and fulfill the terms of this Regulation, which are contained in it including all its applications.
Password for the account is an analog of the Customer's own signature, which is used to identify the Customer.
Partner of the Online Shop - the manufacturer, supplier and / or licensor of Goods and services available through the Online Shop; The Company whose name and logo can be used on the pages of the Online Shop.
Customer's Personal Cabinet is an electronic page on the Site containing the information about the Customer's personal data, the registration’s date, the operations performed by the Customer, the services rendered by the Support Service, purchased goods, amounts and payments, and other information.
Buyer is the Customer who has concluded the Contract for the supply of Goods by filling out the Order and receiving confirmation of the Order from the Seller and making the purchase of the Goods or services using the Online Shop.
User (a potential Customer) is an individual who, due to the transfer to the website address using a web browser or any other program and / or technical devices, has the ability to display the content of the website's web pages and, may acquire the status of the Customer and the Buyer depending on the actions performed.
Seller is the Online Shop in the person of his Owner.
Registration - the procedure for creating a personal page of the User on the site, during which the User, by filling in the appropriate forms, provides the system with the information necessary for the use of the site services. Registration is considered completed only if all its stages are successfully passed in accordance with the instructions published on the site. Acceptance of the Terms of this Regulation by the User is an obligatory stage of the registration procedure. Upon completion of the registration procedure, the User acquires the status of the Client.
Site is the website of the Online Shop https://rito.ua (hereinafter referred to as the Site), which is a communication platform for posting information about goods and services, the Terms of their sale and interaction with the Online Shop.
Support Service (Contact Center) - the Online Shop staff (third parties involved on the contractual basis) who directly manage the Site, perform technical, organizational and other functions to ensure the functioning of the Site and its services, informational, consulting and other support for the Users of the Site, the Customers, and the Buyers.
The Online Shop RITO Owner is LLC "Rіto", EDPNOU (National State Registry of Ukrainian Enterprises and Organizations) 20586315, the Legitimate User of intellectual property rights of RITO brand.
The Online Shop Site content are the protected results of intellectual activity, including texts of literary compositions, their names, forewords, annotations, articles, illustrations, covers, graphic, text, photographic, derivative, compound and other works, user interfaces, visual interfaces, brand names (signs for goods and services), logos, computer programs, databases. As well as design, structure, selection, coordination, interface, overall style and layout of this content within the Site and other objects of intellectual property rights are collectively and / or separately, contained on the website of the Online Shop.
Goods - the object of sale (a product, an item, an accessory), not withdrawn and not limited in a stream of commerce, submitted for sale in RITO Online Shop, by placing in the appropriate section of the Online Shop.
Price - the Goods value set on the Site, valid at the time of the Transaction conclusion.
Cookies are small files that are temporarily stored on the hard disk, enabling to recognize the computer of the User (the Client) during further visits to the Site.
Web beacons are also known as single pixel or clear gif technology, or action tags, web beacons are electronic images that allow the Online Shop to count the visitors who got access to a specific page; are used as a technology for collecting statistical information, can be used on the Site.
Terms used to describe the Site functions, its functional elements, sections and individual services are used in the form in which they are used in the interface of the Site.
RITO Online Shop is a legal entity registered in accordance with the established procedure and acting in accordance with the legislation of Ukraine under the company name "Rito", the organizational and legal form of LLC (limited liability company) and its legal address: 07400, Kyiv region, Brovary town, Sholom-Aleikhem Str.,4, carrying out its activities through the online resource rito. ua and its accompanying services.
This Regulation governing the relationship of the RITO Online Shop and the User (the Customer, the Buyer) throughout the entire period of provision of the Services and the access of the User (Customer, Buyer) to the personalized services of the Site, reflects the mutual rights and duties of the Online Shop in the person of its Owner (the Seller) and the User of the Site (the Customer, the Buyer) in the form of the Public contract (Offer). Use of site services, as well as all relationships between the User (Customer, Buyer) and the Online Shop, associated with the use of Site services, are governed by these Regulation.
By using any of the Site services or taking advantage of any of its services, the User (the Customer, the Buyer) confirms that he is acquainted with these Terms and Conditions and all other Terms set forth on the Site, expresses his unconditional agreement with all the Terms of this Regulation, understands and fully accepts the conditions of the Public Contract without any exceptions and is determined to implement them in every manner possible as well as immediately stop using the services in case of disagreement with any of the Regulation. The User confirms that he has been informed of the extension of the Terms of the Regulation to all currently available Site services, as well as any development and/or addition of new services.
Acceptance of the Terms of the Public Contract is the fact of the use of the Site by the User, which arises at the time the use starts, namely: transfer by the User to the address using a web browser or any other program and / or technical devices enabling the display of the content of the web- pages of the Site. If the User (the Customer, the Buyer) for any reason does not agree with the Terms of this Regulation in whole or in part, the Owner of the RITO Online Shop asks the User to leave the Site. All messages, notifications, claims and any other correspondence sent to each other by the Parties to the Public Contract shall be deemed to be sent in an appropriate manner in electronic form by means of e-mail messages, as well as in the form of messages within the Site provided for in its functional features (forum messages, feedback forms, publications, etc.). Correspondence is also considered to be sent in the proper way, if it is sent by the Parties in writing with the requisite details, in accordance with the procedure prescribed in existing legislation of Ukraine.
The Owner of the Online Shop reserves the right to modify this Regulation without any special notification from third parties. The new version of the Regulation comes into force from the moment of its posting on the website, unless otherwise provided by the new edition of the Rules. The current version of the Regulation is always available at http://rito.ua/.
All content of the RITO Online Shop website is protected by copyrights of the Online Shop Owner and / or third parties whose rights were transferred to the Site Owner legally in pursuit of the execution of the project. Using of materials of this website without the coordination with administration is forbidden. For the legitimate use of the materials of the Site, signing of the licence agreement is necessary (obtaining licenses). When quoting site materials, including copyrighted works, the address of the site should be noted and is possible only after preliminary agreement with the Owner of the Online Shop.

INTERACTION BETWEEN THE ONLINE SHOP AND THE USER
The mutual Rights and Obligations are displayed and detailed in this Regulation of Interaction. The Owner of the Online Shop recommends that persons under 18 should refrain from accessing personalized Site services. The RITO Online Shop does not collect deliberately information received from minors, including personal data, does not use or orient the content of the site on minors. Responsibility for the actions of minors, including the acquisition by them of the Products of the online store using the site, is vested in the legal representatives of minors.
Entitlement to use the services of the Online Shop is available for the individuals who have reached the age of 18 and full capacity to undertake legal transactions- including the right to enter into contracts that are legally effective, in accordance with the current legislation of Ukraine. To confirm the status of the Client, the RITO Online Shop is required to complete the registration form. In this case, the Owner of the Online Shop reserves the right to reject any application for purchase, to block the User (Client) without giving reasons.
The User accepts the obligations not to take actions that may be considered as contradicting and violating Ukrainian law or international law, including in the field of intellectual property rights, copyright and / or related rights, as well as any actions that lead or may lead to violation of the normal operation of the Site and site services.
Nothing in this Regulation can be understood as the establishment of agency relations between the User (the Client, the Buyer) and the Online Shop, the relations of the partnership, the relations of joint activity, the relations of personal hiring, or any other relations not directly stipulated by the Regulation.
On all issues relating to the information support, the User (the Customer, the Buyer) can contact the Customer Service Center or the Contact Center of the Online Shop.
The User (the Customer, the Buyer) has the right to:
• get access to the use of the Site after meeting the registration requirements;
• use all available services on the Site, as well as purchase any Products offered on the Site;
• ask any questions related to the services of the Online Shop on the requisites that are in the site section;
• use the site solely for the purposes and in accordance with the procedure laid down in the Regulation and that is not prohibited by the legislation of Ukraine;
• require the Online Shop to remove the Authorization Code and / or lock the Customer's Personal Cabinet on the website of the Online Shop on the basis of a relevant request sent to the Owner of the Online Shop in writing at any time.
User's Obligations at Registration
In order to purchase the Goods from the RITO Online Shop catalog on the Site, as well as to access the personalized services of the Site, the User agrees to provide accurate and complete information on the issues specified in the Registration and necessary to fulfill the obligations of the Online Shop regarding the purchased Goods and / or access to personalized site services. The User also undertakes to support this information in actual status. In case of providing incorrect information, or if the Owner of the Online Shop has serious grounds to believe that the information provided by the User is incomplete and / or unreliable, the Owner of the Online Shop has the right to block the Customer's Personal Cabinet and / or remove the Authorization Code and refuse the User (the Customer) in the use of their services.
Obligations of the User when using the Site services
The User (Customer) accepts the obligation not to use the Site services in cases of:
• violation of the rights of minors and / or harming them in any form;
• abuses against minorities;
• false impersonation (registration under a foreign person's name) and / or a representative of the organization and / or community without sufficient rights, including for employees of the RITO Online Shop;
• misrepresentation about the properties and characteristics of any Goods from the Online Shop catalog on the site; incorrect comparison of the Goods, as well as the formation of a negative attitude towards persons who do not use certain Goods, or condemnation of such persons;
• uploading of content that the User (Customer) does not have the right to make available under the laws of Ukraine or according to any contractual relationship;
• uploading of content that affects and / or contains any patent, trademark (mark for goods and services), trade secret, brand name, copyrights and related rights, as well as other rights to the results of intellectual activity Owned or lawfully used by third parties;
• uploadings of not accordingly permitted advertising and / or spam;
• collection and processing of personal data, information about the privacy of any person;
• violations of the smooth operation of the RITO Online Shop website;
•violations of Ukrainian legislation and/or internartional law.
The User (the Client) is obliged not to use abusive words, obscene and offensive images, comparisons and expressions, including gender, race, nationality, profession, social category, age, language of a person and a citizen on the site's services, as well as in relation to organizations, state authorities and local self-government, official state symbols (flags, coats of arms, anthems), religious symbols, objects of cultural heritage (historical and cultural monuments).
The User (the Customer) recognizes and endorses that the RITO Online Shop has the right (but not the obligation) at its discretion to refuse to post and / or remove any content available through the personalized Site services.
It is strictly prohibited by the Owner of the Online Shop to:
• use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes for accessing, purchasing, copying or tracking the content of the Online Shop website;
• violate the proper functioning of the Site;
• bypass the navigation structure of the Site to receive or attempt to obtain any data, documents or materials by any means that are not specifically represented by the services of this Site by any means;
• unauthorized access to the Site functions, or any other systems or networks related to this Site, as well as to any services offered on the Site;
• violate the security or authentication system on the Site or in any network related to the Site;
• perform a converse search, keep tracking or make an attempt to keep tracking of information about any other Site User;
• use the Site and its contents for any purposes prohibited by the legislation of Ukraine, and also incite to any illegal activity or other activity that violates the rights of the Online Shop or other physical and/or legal persons.
Informational Support of the Client
The Client gives his voluntary consent to being informed about all the activities of the Online Shop related to the provision of services, including the status of the Order, as well as other events of any nature related to the personalized services of the Site. Information is provided by sending a notification via e-mail and / or SMS notifications to the mobile phone number provided by the Customer at the time of registration on the Site. The Online Shop bears no responsibility for delays, failures, incorrect or untimely delivery, removal or failure of any notices. In this case, the Online Shop reserves the right to re-send any notice, if it is not received by the Customer.
Limitation of Liability of the Owner of the Online Shop
The Online Shop in the person of its Owner shall bear no responsibility for any errors, misprints and inaccuracies that may be found in the materials contained on this Site. The Owner of the Online Shop takes all necessary measures and efforts to ensure the accuracy and reliability of the information on the site presented. All information materials are provided without any guarantees, either explicit or implied. The information on the Site is constantly being updated and at any time it may become obsolete. The Internet store in the person of its Owner is not responsible for obtaining obsolete information from the Site, as well as for the inability of the User (the Customer) to receive updates of the information stored on the Site.
The Online Shop in the person of its Owner shall bear no responsibility for any comments and opinions of the Site visitors, left as comments or reviews. The opinion of the Owner of the Online Shop may not coincide with the opinion and position of the authors of reviews and comments. At the same time, the Online Shop takes all possible measures to prevent the publication of messages that violate the current Ukrainian legislation or moral standards.
The Online Shop in the person of its Owner shall bear no responsibility for any possible unlawful actions of the User (Customer) concerning third parties or third parties regarding the User (Client).
The Online Shop in the person of its Owner is not liable for any damage, loss or expense (real or possible) arising in connection with this website, its use or inability to use, is not responsible or liable for any suspension or termination of the functions and services of the Site as a result of negligence (inaction) or actions (inaction) of any third party.
The Online Shop in the person of its Owner shall bear no responsibility for incomplete, inaccurate, incorrect indication by the User of its data when registering the User.
The Online Shop in the person of its Owner shall bear no responsibility for the availability of resources, links to which may be contained on the website of the Online Shop, for their content, as well as for any consequences associated with the use of the content of these resources by the User.
The Online Shop in the person of its Owner shall bear no responsibility for possible loss and / or damage to data that may occur due to violation of the provisions of this Regulation by the Customer, as well as improper access and / or use of personalized Site services, is not responsible for the use by the Customer or third parties persons of malicious software or hardware that may affect the equipment in connection with the use or download of any material from the Site, as well as for the illegal interference of third parties into the information systems.
The liability of the Owner of the Online Shop as a result of the use of the website or in connection with this Regulation is precluded to the extent that it is permissible under the current legislation in force.
REGISTRATION, AUTHORIZATION, SAFETY
The Online Shop Registration grants to the User both a non-transferable right to use his Authorization Code, which is provided to the User for access to the personalized Site services, and the opportunity of making purchases from the Online Shop catalog.
The User (the Customer) bears responsibility for the security of the Authorization Code, as well as for the use of personalized services of the Online Shop under the authorization of the User (Client). The User independently performs a safe shutdown under the Authorization Code (the "Exit" button) at the end of each session of work with personalized Site services and undertakes to ensure the confidentiality of his Authorization Code to personalized Site services, including not to transmit the Authorization Code to third parties, and also not to obtain it from third parties.
The User (Customer) is obliged to immediately notify the Online Shop of any case of unauthorized access to the Authorization Code and / or any breach of the Customer's Personal Account security on the website of the Online Shop.
In the case of non-use by the Client of access to personalized Site services for a sufficiently long time, the Online Shop in the person of its Owner reserves the right to remove the Customer's Authorization Code. Determining the adequacy of the inactivity of the account in each particular case should be left to the discretion of the Online Shop Owner.
User’s Registration (assignment of the Client's Status to the User) is represented by indicating the User’s login, access password, full name, phone number, and e-mail address.
The status of the Client is assigned after the User enters the data specified in the registration form and presses the corresponding button of the web interface with the text "Register", provided that the User places a checkmark against the text "I accept the User Agreement Terms".
After the User's actions described in this section of the Regulation, the Client's Personal Cabinet is created on the Site automatically, which allows him to start using the Site services.
The Client is obliged to modify the data specified by him at registration with each change.
Cancellation of Client's Status
The Client has the right to cancel his Status at any time and for any reason without obtaining the consent of the Owner of the Online Shop.
Automatically recorded information (not personal data)
When entering the Site (as a Registered User), non personal information (such as a browser type, a number of visits, an average visit duration, the pages visited) is recorded automatically. This information is used as a response in order to improve the query, content and functionality of the Site. Such information may be further used by the Owner of the Online Shop or transferred to third parties, unless the User sends a request for termination of such use to the email address email@example.com
Receipt and Collection of Private Information
The information received from the User before the registration is not personal, the login to the Site is anonymous. As stated above, only the type of browser, computer and operating system, as well as ip-address is going for the Online Shop server statistics. Personal data permitted for processing under this Regulation is provided by the User by filling out the registration form on the website of then Online Shop and contains the following data:
- the User’s full name;
- the User’s phone;
- e-mail address;
- the address for delivery of the Goods;
The User carries out provision of such information to the Online Shop deliberately and on a strictly voluntary basis.
The Owner of the Site does not check the accuracy of the personal data provided by the User. The provided private information about the User when completing the registration forms can be changed or deleted at any time by the User (the Customer) in the Personal Cabinet.
The Online Shop can also obtain private information about the Customer (the Buyer) from the Partners or service providers (for example, about the validation of payment).
Private Information is used:
• for the User registration the Site and providing the User with access to the personalized resources of the website of the Online Shop;
• for identification of the Customer registered on the Online Shop website, for placing an order and buying and selling Goods remotely on the Terms of this Public Contract.
• to establish the feedback from the Customer, including the sending of notices, inquiries regarding the website use of the Online Shop, the provision of services, the processing of requests and applications, processing and receipt of payments, or notifying the Customer about the order status;
• to determine the User location in order to ensure security, preventing fraud;
• for the purpose of providing a guarantee or technical support;
• for providing feedback from the Customer, providing customer support, notifying about changes in the work of Online Shop services;
• to provide to the Client, with his consent, offers and information about promotions, innovations of the Online Shop, promotional e-mails of the Online Shop;
• to improve the Online Shop operation, its evaluation and analysis, develop the quality of the relevant products or services, accumulate experience in communicating with customers.
Cookies and Web Beacons
In accordance with the rules for storing and using of personal information, access to personal data of registered Users – the Clients of RITO Online Shop is limited. Access to the Customer's personal data is provided to the Company's employees, as well as to the delivery services in order to fulfill the task of providing goods and services that have undertaken to ensure compliance with the requirements of the Law of Ukraine "On Protection of Personal Data" and the obligation not to disclose the information received.
Private Information may be provided to third parties only in cases provided by the current legislation of Ukraine and / or with the Client’s consent. The Online Shop reserves the right to inform the relevant law enforcement or government authorities about any activities that, in its view, are unlawful without informing the Client about it.
At payment of the order in the Online Shop using payment cards, all transactions with them are made by banks in special secure modes. No confidential information about bank cards, except notice of the payment made, to the Online Shop is transmitted and can not be transferred.
To protect confidential information (for example, account number) standard industry methods are used. The Client is responsible for taking reasonable measures to protect Private Information from unauthorized access or abuse, including but not limited to protecting the password and other information for access. All actions performed in the system using the analogue of the Customer's handwritten signature are recognized as committed personally by the Client. Changes in personal data can be made only on the initiative and with the Client’s consent.
SALE OF GOODS
Information about the Goods, requirements regarding the acquisition of Goods in the Online Shop.
The Goods are presented on the Site through photo-samples, which are the property of the Online Shop. Each photo-sample is accompanied by textual information: model number, price and product description. The description accompanying Goods on the Site does not pretend to be exhaustive information content and may contain inaccuracies. The presented color of the Goods in the pictures is as close as possible to the original color (it must be borne in mind that the transmission of color largely depends on the individual settings of the monitor). The Online Shop also provides (by phone, via e-mail) additional information that is necessary and sufficient from the Buyer's point of view to make a decision on the purchase of the goods. The price of the Goods indicated on the Site can be changed unilaterally by the Online Shop. Goods that are purchased by the Customer are intended solely for personal use by the Customer (not for commercial purposes!).
Status "Order accepted"
The Goods and their required quantity are reserved for the Customer only after the Order is processed by the Online Shop. In the case of Client’s editing of the Order before its processing by the Online Shop, the prices for the Goods, as well as the availability of the Goods in the Online Shop may vary. In this case editing means the addition or removal of the Goods in the Order in the Personal Cabinet of the Client. Changing the composition of the Order before its processing by the Online Shop is coordinated with the Customer by phone. In the event of a price change of the Goods ordered by the Buyer, the Online Shop informs the Buyer immediately (by phone, via e-mail) to receive confirmation or cancellation of the order. If it is impossible to contact the Customer within 7 (seven) calendar days, including the date of placing the Order, for its agreement, the Order is considered to be canceled. After processing the Order by the Online Shop and confirming the Order, it is given the status of "Order Accepted", which the Customer is notified by sending confirmation to the e-mail specified during the registration of the User and / or by phone. All changes in the order's composition, as well as all stages of the order status, are displayed in the Customer's Personal Cabinet after the assignment of the status "Order Accepted". All information about the Purchases purchased by the Buyer is also displayed in the Customer's Personal Office.
Confirmation of the Order, paid by bank transfer, occurs only after the crediting of funds to the Seller account.
Within one Order, up to 10 ten items can be placed.
Payment for Goods
The Customer has the opportunity to purchase the Goods in the Online Shop, paying for it in the following ways: cash, payment card, bank transfer on receipt.
Payment for Goods in cash
Payment for the Goods in cash is provided to the Buyer when choosing the services of the delivery service of the Online Shop or in the case of the Goods self-removal. The delivery service of the Online Shop operates in the city of Kiev and within a radius of 20 km from Kiev.
Payment for Goods by Payment Card
The Online Shop accepts Internet payments for the Goods through the following payment cards: Visa, Visa Electron, MasterCard and transfers money via Privat Bank (acquiring bank).
The safety of processing Internet payments is guaranteed by the acquirer bank.
Payment card can pay for the Order directly on the website of the Online Shop.
Payment of the Goods by Bank Transfer
For the payment of the Goods by Bank Transfer, the Client, at the time of execution of the Order, has the opportunity to print an already completed receipt. If it is not possible to print the receipt from the Site, the Customer fills in the receipt form himself and is responsible for the correctness of the data entry in the receipt form.
In case of self-completion of the receipt form, it is necessary to indicate the number of the Order issued on the Site in the comment field to the payment. Payment for the Order by Bank Transfer must be made within 3 (three) banking days from the moment of its formation on the Site. In the event of failure to pay for the Order after the specified period, the Order is canceled.
When the Goods are transferred to the Buyer, a cash receipt is provided.
Delivery of Goods
Delivery of goods is carried out throughout Ukraine. Delivery of the Goods is carried out at the expense of the Customer
Delivery to the city of Kiev is carried out by the delivery service of the Online Shop within 1-2 calendar days from the date of confirmation of the Order. Accurate information about the time and date of delivery is agreed with the Customer through electronic or mobile communication.
Delivery in Ukraine is carried out by the partner of the Online Shop - courier service preliminary agreed with the Customer within 2-7 calendar days from the date of Order confirmation, depending on the region of delivery.
Goods Return and Exchange Policy
Return or exchange of the Goods, as well as the refund of money, is carried out at the Customer Service Center, in accordance with the procedure and Terms specified by the Law of Ukraine "On Protection of Consumer Rights" and this section of the Regulation. Return or exchange of the Goods in the places where there is a courier delivery option, is performed by the courier service of the Online Shop or by the Customer’s contacting the Customer Service Center. Return or exchange of the Goods in the regions with postal delivery only is carried out with the help of the postal service preliminary agreed with the Customer.
In order to carry out the return or exchange of the Goods, the Buyer shall send a corresponding written request to the Customer Service Center at the address: Igorevskaya St.5, Kyiv. The application is reviewed by the Online Shop within 7 (seven) calendar days from the moment of its receipt or by email shop @ rito .com.ua.
Refunds are made when the Customer provides a passport, documents confirming the purchase (cash receipt, invoice, payment terminals checks, bank receipt with a note of payment) of the returned Goods, as well as a completed Return of Goods Act and a Request for a Refund. Return of funds for the Goods is carried out exclusively in the manner applied by the Buyer when paying for it.
The difference between the factual design elements, such as the color, shape or design of the Goods, from the declared in the description on the Site, does not affect its quality and does not violate the Terms of the Public Contract. The Online Shop considers claims related to improper quality of the Goods, only in cases when such Goods contain a clear (hidden) manufacturer defect.
Return of the Goods of the appropriate quality is possible during the periods stipulated by the Law on Consumer Rights Protection of Ukraine, if the Goods were not in use, retained the presentation, consumer qualities, seals, labels, and also accompanied by documents issued together with the Goods when buying it. Within 14 (fourteen) days after the transfer of the Goods to the Client (not counting the date of purchase), the Buyer may return the goods if it did not fit the Buyer in color, size, shape, shape, size, for other reasons, it can not be used for its intended purpose, or exchange the Goods of the appropriate quality for a similar one from the Seller.
The exchange of non-defective Goods is made only upon agreement with the Online Shop and only of the Goods that are available for the moment. Return of non-defective Goods is possible only if the Goods were not in use, its consumer properties, presentation, factory labels, accessories and accompanying documents are kept. The Buyer must notify the Online Shop of the desire to return the Goods no later than 3 (three) days after the receipt of the Goods. For the exchange of the Goods, it is necessary to present the product in its original packaging, which retains the presentation, the Warranty card and the documents confirming the purchase (cash receipt, invoice, check of the payment terminal, receipt of the bank with a note of payment).
If the equivalent product is not available for sale at the time of the exchange, the Buyer has the right to either purchase any other goods from the available assortment with the corresponding cost recalculation, or to receive back money in the amount of the value of the returned Goods. There’s also an option to exchange Goods for the same at the first receipt of the corresponding Goods for sale, about what it is notified by the Online Shop. The list of Goods of appropriate quality, which are not refundable, has been approved by the Cabinet of Ministers of Ukraine “On the implementation of certain provisions of the Law of Ukraine “On Protection of Consumer Rights” on March 19, 1994, No. 172.
In the event of a discovery of significant defects that arose due to the fault of the manufacturer of the Goods during the Guarantee Period, or the falsification of the Goods, confirmed if necessary by an expert opinion, the Buyer, in the manner and within the time limits established by the legislation of Ukraine, has the right at his discretion to demand from the Seller:
• the termination of the Contract and return of the amount paid for the Goods;
• the replacement for the equivalent goods, elimination of deficiencies for free.
The Buyer's claims may not be fulfilled if the Seller on the basis of an expert opinion proves that the Goods defects occurred as a result of the Buyer's violation of the Regulations of using the Goods or the conditions of its storage.
The Seller returns to the Buyer the value of the returned Goods, not later than 10 (ten) banking days from the date the Seller receives the Buyer's written application with all accompanying documents, the returned goods, provided full and correct data are filled in.
The cost of courier delivery of goods in the event of its exchange or refund has to be borne by the Buyer.
Warranty and Post-warranty Service
The Guarantee Period of a product is established by the manufacturer. If there is a document to prove purchase of goods, the Buyer in case of necessity of Warranty service shall get in touch with the Contact Center of the Online Shop.
The Warranty extends to the defects of the Goods, which arose through the fault of the manufacturer. The Guarantee Period of operation for the Goods starts from the moment of sale of the Goods and expires at the time specified in the Warranty card (such is attached to the Goods) and / or in the memo when purchasing the Goods, taking into account the terms provided by the current legislation of Ukraine. The Guarantee Period of operation is increased for the duration of the stay of the Goods (products) in the repair. All conditions of the guarantee are regulated by the Law of Ukraine "On Protection of Consumer Rights".
Within the Guarantee Period is allowed and is not considered to be a defect:
• Wear of the parts of the Goods (products), as well as its external and internal coatings during operation.
• Shrinkage or stretching of materials (fabrics) of the Goods during operation and cleaning (washing) is within the normal range.
• Deviation of the characteristics of the Goods (products) from those specified in the documentation within the limits of the norm.
The Warranty does not cover:
• Products that have traces of a malfunction, including but not limited to ruptures, sprains, puffs, marks of bumps and mechanical damages: dents, notches, minor scratches, deformation marks, improper cleaning, and other violations of the proper operation of the Product.
• Damage (external or internal) caused by any mechanical impact, shock or vibration loads, applying external force to parts of the Goods, cracks, chips, scratches, scuffing of surfaces, deformation of materials and parts, etc.
• Damage to the product (product) with water (detergents) as a result of violation of the rules for operation.
• Damage due to exposure to the product (s) of caustic chemicals or solvents.
• Damage to the Goods (products) associated with the loss of stones and other decorative elements.
The Warranty is annulled in the following cases:
• Violations of the rules for operation or use of the Goods (products) for other purposes.
• The lack of proof confirming the Goods acquisition (products).
• Contacting the Customer Service Center after the expiry of the maintenance period.
DISPUTE SETTLEMENT, LEGISLATION APPLIED
Disputes arising as a result of violation (possible violation) of the Terms of this Regulation are settled through negotiations. If the dispute can not be resolved in the specified way, then it is subject to further consideration in court according to the rules of subordination and jurisdiction of this category of dispute and in compliance with the effective legislation of Ukraine.
